Which applicants are passported?
If an individual falls into one of the following categories they will automatically pass the means test:
- those who receive, directly or indirectly, Income Support, Income-Based Job Seeker’s Allowance or Guaranteed State Pension Credit ('Guaranteed Credit')
- those who are under the age of 18
How do they apply?
These applicants must submit a completed Application for Legal Aid in Criminal Proceedings form (CDS14) form to the magistrates’ court staff who will process their application.
Where the applicant does not satisfy any of the passporting criteria, they will also need to submit a fully completed Financial Statement form (CDS15). If they are in custody, they may submit a Statement of Truth form to replace evidence of income (CDS17).

The applicant must also pass the Interests of Justice test to qualify for legal aid.
